Daniel Connal Partnership was appointed by Pizza Hut to advise them in respect of a terminal Schedule of Dilapidations served by their landlord.
Pizza Hut wanted to remain in the property and renew their lease and significantly reduce a dilapidations claim that had been served upon them.
The landlord wanted to obtain possession of the property for redevelopment but did not want to pay Pizza Hut compensation to vacate. The landlord was attempting to use a Schedule of Dilapidations to show that Pizza Hut was not looking after the property properly and therefore should not be granted a new lease.
DCP entered into negotiations with the landlord’s surveyor and were successful in reducing the extent of the landlord’s claim from £250,000 to £25,000. This assisted Pizza Hut in being able to successfully agree a new lease with their landlord.
