Expert Witness
An Expert Witness is required when it is necessary to have opinion based evidence to resolve a dispute.
The Expert Witness compiles an independent, unbiased Report, which is then examined by the other Party and can be used in Court.
The Expert Witness can be appointed as:-
A Party Expert Witness – who is appointed and instructed by one of the Parties in a dispute
A Single Joint Expert Witness – appointed and instructed by both parties.
The primary duty of an Expert Witness is to assist the Court with impartial opinion on matters within his/her expertise. This duty overrides any obligation to the Parties from whom instructions or payment is received. The Court will discount any evidence it deems to be partisan.
Many of our senior surveyors are certified to, and experienced in, providing expert opinion. The Expert Reports and our working practices comply with the RICS Guidance Note and Practice Statement “Surveyors acting as Expert Witnesses”
